1 – Scope of Application

These Terms and Conditions (“Terms”) apply to all sales by BULL Equipment LLC (“Seller”, “we”, or “us”) to both consumers and businesses (“Customer”, “you”) via our website www.bull-equipment.com, by phone, email, or in person. These Terms govern ordering, payment, delivery, product warranty, and any returns or disputes.

These Terms may be updated at any time. The applicable version is the one in force at the time of order confirmation. Your use of our site or purchase of a product indicates agreement to these Terms.

2 – Products

Product specifications, images, and descriptions are listed for informational purposes. Actual product appearance or features may vary. Customers are responsible for reviewing all specifications and confirming suitability before purchasing.

3 – Pricing and Payment

All prices are in U.S. dollars (USD).

  • Cash/Wire Pricing: Net prices apply for payments via bank transfer.
  • Financing Pricing: If paying via third-party financing (e.g., Affirm or Klarna), an adjusted price including processing fees will apply.
  • Sales Tax: Applicable sales tax is calculated at checkout based on delivery location.
  • Shipping: Quoted separately; varies by state and delivery method.

 

Payment must be made in full prior to delivery unless a financing agreement or written exception is made.

4 – Orders and Cancellations

Orders may be placed online, by phone, or by email. An order is considered final only after:

  • Acceptance of these Terms
  • Receipt of full payment (unless otherwise agreed)
  • Seller confirmation via email

 

Cancellations:

  • Orders may be canceled prior to shipment with written notice.
  • Once shipped or picked up, orders are non-cancelable and non-refundable, except where legally required.

5 – Delivery and Pickup

We offer:

  • Nationwide Delivery: Via independent carriers. Delivery occurs at curbside unless otherwise arranged.
  • Warehouse Pickup: From our facility in Hutto, TX, by appointment only.
  •  

Risk of loss transfers upon delivery or pickup. Delivery dates are estimates and not guaranteed. Late delivery does not entitle the Customer to compensatio

6 – Returns and Right of Withdrawal (Consumers Only)

Under U.S. federal and Texas state law, we do not offer a right to return or cancel once the product is delivered, unless the product is:

  • Defective
  • Damaged in transit
  • Not as described in writing

 

Eligible returns must be requested within 3 business days of delivery, and returned in unused condition in original packaging. Return shipping is at the buyer’s expense unless otherwise agreed.

7 – Warranty

All BULL excavators sold in the U.S. include a 24-month limited warranty covering parts only (labor not included). Certain parts (e.g., hoses, filters, fluids, bucket teeth) are excluded as wear items.

Claims must be submitted in writing with photos or videos within 72 hours of issue discovery. Seller reserves the right to determine the remedy (repair or part replacement). No warranty applies if:

  • Product is modified without our written consent
  • Product is misused, overloaded, or operated improperly
  • Product is used for commercial rental without prior approval

8 – Limitation of Liability

To the fullest extent permitted by U.S. law:

  • We are not liable for indirect, incidental, or consequential damages.
  • Our liability is limited to the value of the product purchased.
  • We are not responsible for damages from improper use, lack of maintenance, or unauthorized repairs.

9 – Compliance and Use

The Customer is responsible for ensuring:

  • Product use complies with local laws, safety regulations, and operator qualifications.
  • Safe transport, storage, and operation of equipment.

We do not provide legal or operational training. Equipment should only be operated by trained and qualified individuals.

10 – Data Privacy

We collect and use personal data in accordance with our U.S. Privacy Policy, available on our website. Data may be shared with payment processors and shipping partners for transaction purposes.

We comply with U.S. privacy laws including the Texas Data Privacy and Security Act (effective July 1, 2024). You may contact us to request data deletion, access, or correctio

Governing Law and Jurisdiction:

These Terms are governed by the laws of the State of Texas.

Any disputes shall be resolved exclusively in the courts located in Williamson County, Texas.
